& Terms and Conditions.Your rights to cancel your Contract or order, as detailed herein, shall only apply to a person who purchases goods as a consumer buyer and is resident within European Economic Community where rights which accrue By virtue of the Consumer Protection (Distance Selling) Regulations 2000 Apply .All orders are accepted by Exactrep on these conditions of sale, unless otherwise agreed in writing by the Director of the company. No liability can be accepted for errors or omissions in any technical data or literature supplied to the customer. Exactrep may in certain circumstances, decline to trade with any company or individual. Also and not withstanding any other provisions of these conditions of sale, Exactrep may decline to accept any order, whether or not payment has been received, by giving the customer notice of non-acceptance within twenty one working days of receipt of an order. Should a customers order not be accepted in respect of which payment has been received, the full amount of any such payment will be refunded. Dealer discounts are given on the agreement that payment is received within 30 days, if not received within the 30 days then we reserve the right to re-invoice for the discounted amount.
1)Advice of Non-arrival of goods must be made within 10 days.
2)Claims for damage or short delivery will not be accepted unless made within 7 days of delivery.
3)Exactrep reserves the right to modify goods and specifications without prior notice in the interest of product development.
4)Whilst every care is taken in all stages of manufacture Exactrep will not accept any liability, responsibility for damage, injury, loss, or subsequent cost or expenses incurred as a result of the use or due to bad fitting of the Company's products,(or lack of pre-fitting/inspection before finishing of parts) or by unqualified persons.
5)You have the Right to cancel the order any time up to the end of seven working days after you have received the goods, unless you have ordered Special order goods. A working day is any day other than weekends, Bank holidays or other Public holidays. You must give notice to Exactrep in writing, by hand, post, fax or E mail (a phone call is not enough!), giving details of the goods ordered, Invoice No and (where appropriate) their delivery, your reason for returning the goods. Goods returned by virtue of this or any other clause must be returned in the original packaging (and without being installed or used with all relevant seals and enclosures intact) complete and in the same condition as was despatched. To Exercise your rights of Cancellation, you must firstly contact Exactrep as to your intention, Quoting your Order No Date or Invoice No. You will then be given a "Returns Number", which must accompany a written letter within the returned parts package. Goods must be returned to the address on the Invoice.
6)Goods for return Must be prior arranged and at the Company's discretion with Exactrep and may be subject to a 15% handling charge. No returns cost for faulty goods.
7)Title of the goods remain with the Company until full payment is received for the goods and the buyer will agree that up to the time of full payment (or at any later time if payment is withdrawn), the Company may at any time enter the premises of the Customer and reclaim the goods invoiced.
8)It is the buyer's responsibility to insure the goods from the time of loading at the Company's premises, as the goods are ex-works, excepting where the goods are being delivered by the Company's own transport wherein liability will cease at the point of unloading.
9)No goods manufactured by the Company shall be affixed thereto by the buyer any mark sign or lettering additional to that affixed by the Company except with the written authority of Exactrep. Nor shall any document literature or other representation whatsoever be made by the buyer directly or indirectly as representing the goods as being other than of the manufacture construction or design of Exactrep.
10)Refunds will only be given on parts returned providing they are received in the original condition sent (see point 5 above) and accompanied by a copy or the original invoice.
Delivery Normally, orders received are despatched within 24 hours. Exactrep accepts no responsibility for failure to deliver within the estimated delivery times. The customer must inspect delivered products as soon as is reasonably possible following delivery. Any damage or shortage must be reported to Exactrep within seven working days. If the customer fails to give such notice, the product shall be conclusively presumed to be in all respects in accordance with the contract, and free from any fault or defect, which would be apparent on reasonable examination. The customer shall be deemed to have accepted the products accordingly.
Order with Confidence Prices are correct at the time of going to press. However, prices may change at any time, either Up or Down. Please confirm current prices at the time of ordering. We want to make sure that you are completely satisfied with every thing you order and with every aspect of our Service. We constantly encourage our suppliers to improve the quality and update the specifications of their Products, so when you sometimes find minor variations, you can be sure that they are changes for the better.
Exports The customer acknowledges that any products or technical data may be subject to the export control restrictions applicable to Exactrep and / or the customer under U.K. or foreign laws or regulations. The customer will not do or omit to do anything that would place Exactrep in breach of the said laws and regulations.
Guarantee Most components are guaranteed for one year. Exactrep guarantees, at its discretion, to refund the price of the goods or to replace free of charge any goods found to our satisfaction to be defective within twelve months from the date of despatch, provided that the goods have not been subjected to conditions beyond their specification, and all reasonable care has been given to them. Exactrep will undertake to inspect any defective goods. If these goods are found to be in good working order Exactrep reserve the right to make minimum administration charge to the customer. Exactrep will not accept returned goods without prior consent, except under guarantee.
